SOCIAL MEDIA & USER GENERATED CONTENT (UGC) POLICY

This policy governs the ways in which LORAIN SRL may use content (photos and videos) posted by users on social media.

1. Data Controller
The Data Controller is LORAIN SRL, with registered office at Via Industria 1, Morbegno (SO), hereinafter referred to as the “Brand.”

2. Applicable Content
This policy applies to photographic, video, and multimedia content posted by users on social media that feature the Brand’s products, regardless of whether the user has tagged the Brand’s official social media profiles.

3. Request and Granting of Consent
The Brand may contact users via direct message or other channels to request explicit consent for the use of their content.
Consent is considered valid only if given through a positive, specific, and documentable action, such as, for example:

  • a positive written response to a message from the Brand;
  • completion of a release form;
  • use of hashtags specifically indicated by the Brand as valid for consent purposes (#liodbylorain).

4. Purpose of Use
With the user’s consent, the content may be used by the Brand for purposes of:

  • communication;
  • marketing;
  • promotion and enhancement of the Brand and its products.

5. Scope of Use
Authorized content may be used worldwide on:

  • the Brand’s official website;
  • the Brand’s social media channels;
  • digital advertising campaigns;
  • offline and printed promotional materials, including but not limited to catalogs, posters, calendars, brochures, displays, and other printed media.

Use will always respect the user’s image, personal dignity, and decorum, excluding any harmful or prejudicial contexts.

6. No Compensation
Authorization to use the content is granted free of charge.
The user expressly waives any request for compensation, payment, or indemnity. Furthermore, if ideas, suggestions, or concepts are submitted, the Brand may use them freely without providing any compensation or acknowledgment to the sender.

7. User and Third-Party Declarations
The user declares:

  • to be of legal age;
  • to own all rights to the shared content;
  • to have obtained consent for the use of images from any third parties depicted in the content.

The user agrees to indemnify and hold the Brand harmless from any claims, complaints, or requests made by third parties regarding the use of the content.

8. Minors
Content featuring minors may only be used with the written consent of both parents or legal guardians. Without such consent, the content will not be used.

9. Duration and Revocation of Consent
Consent for the use of content is valid until revoked by the user, which can be done at any time by contacting the Brand via the website chat.

Revocation of consent:

  • does not affect the lawfulness of processing carried out prior to revocation;
  • does not require withdrawal, destruction, or modification of materials already created, printed, distributed, or published before the revocation;
  • the Brand will, where technically possible, cease using the content for future digital publications, including social media channels, the website, and digital campaigns, but cannot guarantee removal from offline materials already distributed, such as catalogs, posters, brochures, or other printed media;
  • the Brand is not responsible for any copies, sharing, or reuse of content by third parties, even without the user’s consent, once the content has been made public.
